On November 6, 2024, the Beijing Intellectual Property Court released its White Paper on the Judicial Work of the Beijing Intellectual Property Court in the Past Ten Years (2014-2024). 

The white paper, presented in both Chinese and English, highlights a decade of progress, reforms, and significant achievements in the field of intellectual property (IP) judicial protection.

Key Highlights of the White Paper

The document is divided into six sections, giving a Comprehensive Overview of Achievements: 

  • Overview and trial data

  • Typical cases and adjudication principles

  • Effectiveness of protection and achievements

  • Judicial reforms and innovations in mechanism

  • Talent cultivation and team development

  • Foreign-related cases and international cooperation

This structure provides a detailed account of the court’s efforts to enhance judicial protection, implement legal reforms, and build a specialized, professional team.

Case Statistics and Efficiency

From 2014 to 2024, the court handled 201,984 cases, concluding 195,506. The caseload covered various IP matters, including patents, trademarks, copyrights, unfair competition, and monopoly disputes. Notably, 283 cases received awards or were included in legal collections, while 75 cases were recognized as exemplary by the Supreme People's Court.

The court has achieved a high efficiency rate by resolving over 46% of simpler cases with only 17% of its resources. It also pioneered electronic reforms, boasting a 91.7% online filing rate, making it a leader among Beijing courts in terms of digital adoption.

International IP Protection

The Beijing IP Court has actively engaged in the protection of foreign parties’ IP rights, handling 36,201 foreign-related cases (17.92% of total cases), involving entities from over 100 countries and regions. 

To streamline the handling of international cases, the court introduced new procedures for serving legal documents and designated business agents in trademark cases, improving the efficiency and success rate of document delivery.

A bilingual guide for foreign litigants has also been published, covering the legal requirements and qualification verification for participants from 18 major countries. This initiative aims to clarify the procedural steps and increase transparency for international parties.

Focus on Emerging Technologies

Looking forward, the court aims to enhance its IP protection framework in alignment with international standards, particularly in emerging areas like artificial intelligence and new technological fields. This forward-thinking approach indicates the court's readiness to address complex legal issues arising from technological advancements.

Strategic Impact

The white paper underscores the court’s role in supporting China’s innovation-driven strategy, aligning its practices with the national agenda to strengthen IP protection as a critical element of economic growth. The specialized nature of the court has allowed it to focus on complex IP matters, contributing significantly to the legal framework's modernization and efficiency.

The Beijing IP Court’s efforts in the past decade reflect a commitment to both national priorities and international best practices, cementing its position as a key player in China’s IP judicial landscape.
