The patent preliminary examination service is the fast patent examination and fast patent confirmation service implemented by the Shanghai and China (Pudong) Intellectual Property Protection Center (IPPC) according to the approval of the China National Intellectual Property Administration.
Generally speaking, the examination period for inventions is 3-5 years, while the examination period for designs and utility models is about 6-8 months. However, patents applied for through rapid pre-examination can greatly shorten the examination period.
Pre-examination inventions receive examination results within about 3-6 months from the date of application; The pre-examination of utility models can receive the examination results within about 3-6 weeks from the date of application; The pre-examination design examination results can be received in about 2-4 weeks from the application date.
The requirements and process for rapid patent pre-examination are as follows.
1. Shanghai Intellectual Property Protection Center
(1) The applicant's registered place and tax household management place are both in Shanghai;
(2) The industrial field belongs to the new materials and energy-saving and environmental protection industries;
(3) The patent application classification number is within the examination scope of Shanghai IPPC;
(4) Having a certain patent reserve;
(5) No abnormal patent application recognized by the China National Intellectual Property Administration within three years, and no patent dishonesty in the past three years;
(6) The application materials for filing have been submitted in the Shanghai Intellectual Property Service System
2. China (Pudong) Intellectual Property Protection Center
(1) The applicant's registered address and tax household management location are both in Pudong, Shanghai;
(2) The industrial field belongs to biomedicine and high-end equipment manufacturing;
(3) The patent application classification number belongs to the examination scope of Pudong IPPC
(4) Having a certain patent reserve;
(5) No abnormal patent application recognized by the China National Intellectual Property Administration within three years, and no patent dishonesty in the past three years;
(6) The application materials for filing have been submitted in the intellectual property service system of Shanghai Pudong Center
3. Quick Pre-Examination Process
(1) Enterprises first need to submit filing application materials on their own in the IPPC Property Service System, and can only proceed with patent rapid pre-examination applications after passing the filing process;
(2) Submit the application documents to IPPC;
(3) After the IPPC confirms that it has passed the preliminary examination, the applicant shall submit the application documents to the China National Intellectual Property Administration;
(4) Examined by China National Intellectual Property Administration.
Whether it is an invention, utility model, or design application, as long as the above requirements are met, rapid pre-examination can be conducted.
Pre-examination does not require additional official fees, and the examination period is significantly shortened, making it a great choice for companies that want to quickly obtain patent rights.
